On March 11, 2021, President Biden signed the American Rescue Plan Act of 2021 (Rescue Act). While most news reports regarding the Rescue Act focus on the stimulus checks many Americans have received or are expected to receive, there are also employment-related aspects of the Families First Coronavirus Response Act (FFCRA) that were modified by the Rescue Act. Businesses and employees continue to deal with the ever-changing employment landscape arising from the COVID-19 pandemic. Most recently, the changes are occurring on a local level. On March 9, 2021, Allegheny County Council passed a bill mandating paid sick leave for employees of businesses situated or doing business within the geographical boundaries of Allegheny County with more than 25 employees. The Pittsburgh Covid-19 Emergency Paid Sick Leave Ordinance was passed by the City of Pittsburgh on December 9, 2020, and takes effect immediately. It imposes additional COVID-19 paid sick leave requirements on employers beyond those provided under the Families First Coronavirus Relief Act and the previously enacted Pittsburgh Sick Days Act. In 2019, the Pennsylvania General Assembly enacted Act 85 which authorizes and allows drillers to ignore the express terms of a pooling clause and drill wells that cross unit boundaries. The recent case of Hordis v. Cabot Oil & Gas Corporation, where the landowner is contesting and disputing the driller’s authority to drill cross-unit wells, may be the first of many lawsuits in Pennsylvania challenging Act 85 and the notion of multi-unit wells.
