At the preliminary hearing the robbery charges were dropped and the Commonwealth proceeded on the gun charges only. This is something I've been pondering since I was in law school. In a class on Civil Rights litigation we learned that the average police officer gets 12 hours, yes 12 hours, of training on what the current Constitutional law relevant to law enforcement is. This was over a decade ago. I wonder if it's changed. Also look up police salaries in your city. In Philadelphia with decent overtime most police officers with a few years under their belts make as much if not more than th...e Assistant City Solicitors who defend them against civil rights lawsuits, and the police don't have massive law school debt. Also, if police are trained up they will be worth more and they might just stop racking up large settlements and jury verdicts for actions stemming from their lack of training. Charging a victim of police violence with assault and/or resisting arrest (especially where there is no underlying crime for which an arrest would be necessary) is a common tactic to cover up the abuse. Just last year I convinced a judge to discharge an Aggravated Assault against a police officer, a crime that carries a maximum 10 year sentence. The Assistant District Attorney requested a continuance of the preliminary hearing because the arresting officer was on leave due t...o an injury he suffered during the alleged Assault committed by my client. The injury was a broken hand. Normally when an officer is out for that the case just gets continued until he comes back from leave. I pointed out a fact to the Court that the Assistant District Attorney just so happened to leave out when requesting a continuance. I brought to the Court's attention the fact that the officer broke his hand on my client's head after making a forced warrantless entry and tackling my client to the floor. Fortunately for my client the Court was not willing to continue the case considering the source of the officer's injury. Unfortunately not all people wrongfully charged get their cases dismissed. Many take deals to get out of prison. The conviction and probation almost always holds the person back and prevents them from getting jobs and chasing the American Dream that is supposedly within reach for anyone who wants it.
