A mother wrongfully deprived a father and his parent-grandparents of his two young children's custody for 8 months until yesterday when a judge reunited them. All they had was precious memories and pictures to get them through that difficult time. Affordable Legal prevailed with restoration of custody, additional time to make-up for the time lost, and sanctions of court costs and counsel fees. Yesterday was a great day for our client and his family.

Legal Tip for College Students Part II - "Just Say No to Consent Searches Without a Warrant- 4th Amendment Protection Against Unreasonable Searches & Seizures." You are in your dorm minding your own business when Public Safety (PS) knocks on your door. You open and they ask to come in. 1) You do not have to consent. ... It is best to step out into the hall and (with key card in hand) close the door behind you. PS tells you that they want to ask you some questions and to tells you it would be better to "step inside." You are panic stricken at this point and make the mistake of letting PS step in. They ask a few questions, then ask if they can "look around." 2) You do not have to consent to search without a search warrant. They tell you that if you do not consent, they will remove you from your dorm while they obtain a warrant. You believe that things would go much easier if you consented. However, if contraband was found after they obtained a warrant, it may be suppressed as evidence if the warrant was not based on probable cause. (More on probable cause on Legal Tip for Tomorrow.)

It could have ended much differently for this guy. Affordable Legal commends the patience that the police officers in the city of Ammon, Bonneville County, Idaho on scene had that day.

A Frightening Experience for a Young Girl... A girl in her twenties who never had an encounter with the law was arrested and charged for employee theft. Rather than have a bench warrant issue where the police would come to her home, Affordable Legal made arrangements with the authorities for the client to turn herself in, saving much embarrassment and uncertainty. Following her turn-in, the police could have held her for fifth teen to thirty hours with others criminal defenda...nts in a detention cell. She was petrified and fragile. Affordable Legal's attorney Andrew Callahan with concerted commitment, employed artful persuasion in his numerous calls, and sent out faxes to the proper parties in an effort to have our client released in time for the New Years weekend. Andrew's diligence paid off by obtaining a hearing within 2 hours from the time of the client's detention to have her released without posting bail. Misuse of Protection From Abuse Orders... We defended a father-client against a Protection From Abuse Court Order which prohibited him from seeing his 2 young children for over a month. The children's mother filed for the Order making meritless claims that hers and the children's lives were in placed in danger by the father's actions. On behalf of the father, we presented evidence to the contrary to the Judge who held in his favor lifting the Order thereby granting him the legal right to see his children under his Court Ordered custody. Parents so often abuse the Family Court system by filing Protection Orders against each other to further their own agendas. Family Law should be modified to allow for the recovery of counsel fees by the prevailing party.
